Whаt chаrter right mаy be viоlated in the scenariо belоw? Helen Smith is a lifeguard at a public swimming pool that is owned and operated by the City of Ottawa. She is the most senior of 10 lifeguards on staff and has the most experience and training. Based on her seniority, she is allowed first choice at the lifeguard schedule. Since she attends university classes in the morning, she has chosen to work five afternoons a week at the pool. She depends on her lifeguarding income to pay tuition, rent, and all other life expenses. Helen is also trans. Five years ago, before beginning her employment with the city, Helen underwent gender confirmation surgery. On Wednesday afternoons, the pool offers a "women only" swim time that is primarily attended by Hasidic Jewish women who otherwise feel uncomfortable swimming or cannot swim in the presence of men. In fact, the "women only" swim was initiated in response to a request from the Hasidic community for a designated women's swim time. The community also requested that only women lifeguards be assigned at that time. The "women only" swim has become popular and is widely supported by many women across many creeds. Helen worked the Wednesday "women only" swim; however, after a few weeks, some of the women began to question whether Helen was "born" female. They requested her removal as a lifeguard from the Wednesday afternoon swim. Community representatives also indicated that because of their religious and cultural beliefs, they would have to stop accessing the "women only" swim if Helen was not removed as a lifeguard. After an emergency City Council meeting, the City instituted the following policy: "For the purposes of any City activities that are designated 'women-only', only female staff who were born as females should be assigned." The City is very concerned that some religious communities may feel excluded from public City activities and wishes to ensure that all historically marginalized groups feel comfortable participating in City events and City spaces. The City considers it a priority to develop programs and safe spaces for those who may otherwise feel barred from participation. As a result of the policy, Helen's supervisor asked her whether she was born female. Despite the question being completely inappropriate, Helen explained to her supervisor that she is trans. As a result of her response and the policy, Helen was reassigned to a Wednesday morning swim time. While her supervisor did not publicly announce the reason behind the change, other staff soon discovered the reason through pool rumours. Helen's co-workers rallied behind Helen to support her, but her supervisor would not change the shift. Helen was devastated by the City's policy, its implication about her womanhood, and the shift-change. She is unable to work on Wednesday mornings and has therefore lost one day's employment per week. She has become depressed and feels ostracized at work.
