QUESTION 1 – 5 Pоint In Jаnuаry 2021 Hаrdy entered intо a written and signed lease оf a commercial retail store located in Kohler, Wisconsin.  Hardy operated a home décor shop.  The landlord was Libman.  The written and signed lease provided for a four-year lease term ending January 2025.  Under the lease, Hardy was required to pay Libman rent of $8,000 per month.  At the time, Hardy could afford such a high rent payment because the shop was very successful.  Unfortunately, Hardy’s shop has fallen on hard times.  In December 2021 Hardy approached Libman about modifying the lease.  Hardy told Libman that he could no longer afford the lease payments and was thinking about just leaving the premises.  Hardy offered to pay Libman monthly rent in the amount of $5,000.  Libman did not want an empty store.  Libman agreed, in a signed written modification, to decrease the monthly rent to $5,000 a month for all of 2022 and 2023, but required Hardy to add a year to the lease and to pay $8,000 a month during all of 2024 and 2025 (so the lease now expired in January 2026).  Hardy signed the modification.   Shortly after signing the modification, Cote approached Libman indicating an interest in renting the space that was occupied by Hardy.  Cote really wanted the space and was willing to pay $9,000 a month for a long term lease.   Obviously, Libman really wants to rent the space to Cote for the increased rent.  Libman sent Hardy a letter telling him that the modification was unenforceable because the modification lacked consideration.  Libman indicated that Hardy must pay $8,000 a month under the original lease or leave the premises immediately.  Hardy disagrees.
