Write а legаl memо including аn analysis оf the fоllowing situation and conclusions. Our potential client is Henry Ford, a 28 year old man.  Henry was visiting a friend on November 3, 2019 at Doggy Tail Trail in Wonderland City.  The home is owned by Larry and Betty White.  Henry is friends with Snowy, Larry and Betty’s daughter.  When visiting Snowy, including this visit, Henry will call ahead and ask Snowy to put the dog up before he arrives at the house.  Henry admitted to being afraid of the dog.  The dog is a 5 year old Husky dog. On November 3rd, Henry arrived at the house at about 7:00 pm.  The dog was restrained in a bedroom.  The dog was let out into the house 2 to 3 times during Henry’s visit.  During those times, the dog allowed our client to pet it, and showed no signs of aggression.  Larry and Betty eventually went to bed, leaving Henry and Snowy in the house with the dog loose.   At one point, Henry was petting the dog.  At some point while petting the dog, Henry moved to leave and that is when the dog attacked.  There were no warning signs at all.  Henry remembers that everyone came running in to help. An ambulance was called to the scene as well as police and animal control.  Animal control removed the dog from the premises.  Henry was taken to the hospital and received 20 stitches on his face and was released the following day. Rules / Laws: This case could be either a simple negligence case or a strict liability case.  Our case would fall under “negligent handling of animals”, which elements are set out in case law as follows: The defendant was the owner or possessor of the animal. The defendant owed a duty to exercise reasonable care to prevent the animal from injuring others. The defendant breached the duty. The defendant’s breach proximately caused the plaintiff’s injury. The primary authority regarding the elements above is case law.  “The defendant owes a duty to exercise reasonable care to prevent its animals from injuring others.  Bushnell v. Mott, 254 S.W.3d 451, 452-53 (Tex.2008). This duty includes being aware of circumstances that might cause an ordinarily gentle animal to attack other animals or people.  Restatement (2d) of Torts §518 cmts. h.”  Additionally, a claimant would have to show that the Defendant did not use the degree of care a reasonably prudent person would have used in handling the animal.  See Dawkins v. Van Winkle, 375 S.W.2d 341, 344 (Tex.App.—Waco 1964), writ dism’d, 377 S.W.2d 830 (Tex. 1964).  Last, according to under Chapter 7, Section 7-5.1(2)(A) of the Wonderland City Code), Animal Control, if the attack happens in the dog’s own house, the city does not necessarily consider a dog dangerous.  It will if the dog was out loose. HINTS: There is no civil statute that governs dog bites.  The case cannot be brought as a premises liability action. ASSIGNMENT: Review the facts and law and write a legal memo to me, from you and state:  (i) whether the client has a viable action, and if so, what type of action; (ii) what elements would need to be proven by the client (depending on the action you choose); and (iii) what kind of evidence is available to prove the elements.
