Jоаn Perkins wоrked frоm 1985-20222 аs аn administrative assistant for Armor Pipes Inc. ("API") in Norfolk, Virginia. In support of this motion, API points to evidence that Joan, a clerical worker, did not work in any part of the factory where asbestos fibers were used.  In opposition to API's motion, Joan argues that she knows of no other possible exposure to asbestos. She also submitted admissible expert testimony that the only thing that could explain Joan's lung cancer was exposure to asbestos, and that the only way she could have been exposed to asbestos was if API failed properly to protect its office workers like Joan from exposure to asbestos in the ventilation system. Further investigation discovered minute amounts of asbestos in the venting of that part the API factory where Joan worked.  Finally, in further support of its motion for summary judgement, API presents evidence that Joan smoked 2 packs of cigarettes every day for the last 20 years, arguing that it was her smoking that caused her lung cancer not asbestos exposure.  In response, Joan presented other unrebutted expert testimony that the incidence of lung cancer in the general population of heavy smokers is 150/100,000 but the incidence of lung cancer in heavy smokers who also had some asbestos exposure, like Joan established, increased to 250/100,000.
