QUESTION THREE 30 MINUTES (20 POINTS) Wаlter аnd Skyler were mаrried fоr twelve years befоre they оbtained a valid dissolution of their marriage here in Oklahoma. Walter and Skyler did not have a prenuptial agreement. Before they were married, Walter gave Skyler an engagement ring. At that time, prior to their marriage, they each had individual retirement accounts. The accounts continued to be held separately during their marriage and increased in value despite the fact that no additional contributions were made. While they were married, Walter's uncle died and left Walter a mountain cabin. Shortly thereafter, Skyler insisted she be added to the deed on the cabin, and Walter put the cabin in both his name and Skyler's name as joint tenants. Additionally, Walter had 1 bank account prior to his marriage to Skyler with substantial funds in said account to which he never contributed any additional funds during the marriage. During the marriage, without Skyler's knowledge, Walter put Skyler's name on his premarital bank account as a joint owner with rights of survivorship, Skyler was unaware of this account and never had access to this account. During the marriage, Walter purchased a Lamborghini in his name with the funds that were in the premarital bank account. Skyler was unaware of the Lamborghini as Walter stored it off site in a storage unit. During the first seven years of their marriage, Walter took out substantial student loans to pay for his education. Skyler worked as a bookkeeper and supported the couple while Walter was attending school. At one point during this period, Skyler needed an automobile for transportation to work. She obtained a station wagon from a neighbor in exchange for the engagement ring Walter had given her. When Walter graduated, Skyler stopped working and became a stay-at-home mom to the couple's young daughter. On the date of the dissolution of marriage, Walter made $250,000 per year and Skyler was not employed. The court made a property division, considering the retirement accounts, the station wagon, the mountain cabin, Walter's premarital bank account and the student loans. The court did not make any ruling with respect to the Lamborghini, as it was not referenced in the case, and it was omitted from the Decree of Dissolution of Marriage. Additionally, the court ordered Walter to pay Skyler child support in the amount of $1,000 per month, plus $3,000 per month for 5 years in support alimony. Now, 3 years after the dissolution became final, Walter learned that Skyler recently obtained a six-month contract position for which she is receiving $2,500 per month. Skyler's boyfriend also stays overnight 5 out of 7 nights per week. Walter recently took an indefinite leave of absence from his job as an oil and gas executive where he was still earning $250,000, rented out his expensive home for $3,500 per month, and plans to sail around the world over the next 12 months. Walter estimates his expenses will be equal to or greater than the money he receives form renting out his home. Walter does, however, have a small amount of funds left in his savings account after giving an equal amount to Skyler. Skyler on the other hand, has $100,000 in cash in her savings account that she received from the divorce ruling, which thus far she has not had to utilize such funds based upon the child support and support alimony award. Both parties continue to have retirement account funds from the dissolution; however, neither Walter nor Skyler are able to withdraw such funds for another 10 years, without taking a penalty. Walter has filed a motion requesting his support alimony be modified such that he be relieved of his support alimony payments, or in the alternative, that Skyler's support alimony award be reduced. (The couple's child is now an adult, thus Walter no longer has child support obligations). QUESTIONS: 1. Discuss how the court should have classified the retirement accounts, the station wagon, the mountain cabin, Walter's premarital bank account, the Lamborghini, and the student loans, for purposes of distributing the property at the time of dissolution of marriage. 2. Discuss the law applicable to the court's consideration of Walter's motion seeking modification of support alimony and the factual consideration to the request to modify support alimony.
