Perdue.  In that case, the DC Circuit had to evaluate two challenges to a USDA decision (1) one to the USDA's rules for renewing the licenses of animal dealers and exhibitors and (2) another to the USDA's decision to renew the license of two individuals (the Sellners) to own and operate a zoo - even though the ALDF and its members claimed the USDA had evidence - including letters from ALDF members describing unsanitary conditions and poor treatment of animals - showing that the Sellners' zoo was "in violation of numerous animal welfare requirements under the Act and its implementing regulations." In the first of these challenges, its statutory interpretation challenge, ALDF claimed that because the Animal Welfare Act stated "no ... license shall be issued until the ... exhibitor shall have demonstrated that his facilities comply with the standards promulgated by the Secretary," 7 U.S.C. § 2133, the USDA had to adopt rules that would require animal exhibitors like the Sellners to provide evidence to the USDA showing that they had complied with USDA standards - for example, the results of an inspection of the Sellners' facilities.  However, the USDA required the Sellners (or others renewing a license) to provide only a signed "self-certification" of their compliance with agency regulations (in a regulation in 9 C.F.R. §§ 2.3).   What would the DC Circuit have to have concluded about the USDA's self-certification requirement to have found against the USDA at Chevron Step 1?  The DC Circuit instead found that it had to evaluate the USDA's self-certification requirement at Chevron Step 2. What does that indicate about how the DC Circuit interpreted the statutory language in 7 U.S.C. §2133 (and what specific statutory language arguably creates the ambiguity that justified applying Chevron Step 2?)   Although the DC Circuit decided in favor of the USDA on the statutory interpretation dispute, it agreed with the ALDF that the USDA's decision to renew the Sellners' license might be "arbitrary and capricious."   Please briefly (1) explain how this USDA decision could be "arbitrary and capricious" when the DC Circuit agreed with the USDA that the USDA's interpretation of the Animal Welfare Act was permissible and (2) describe the State Farm factors courts use to determine if an agency decision is "arbitrary and capricious" and briefly describe one reason the ALDF might present that the USDA's decision to renew the license was "arbitrary and capricious" under at least one of these factors.
