Pan sues DazzleDish for failing to comply with the Fair Labor Standard Act (FLSA).  In response, DazzleDish Pizza cites a Department of Labor (DOL) opinion letter allowing them to pay an "approximation" of the actual vehicle costs.   Prior to this opinion letter, the DOL had issued a rule through notice and comment rulemaking- the "anti-kickback rule" - which states: "The wage requirements of the [Fair Labor Standards] Act will not be met where the employee 'kicks back' directly or indirectly to the employer or to another person for the employer's benefit the whole or part of the wage delivered to the employee." This rule also states that, where employers with delivery services require employees to drive as part of their work and it is difficult to determine exactly how much an employee has spent on vehicle-related expenses, an employer can "either (1) keep records of delivery drivers' actual expenses and reimburse for them or (2) reimburse drivers at the IRS standard business mileage rate." But in a subsequent "opinion letter," DOL interpreted its own "anti-kickback" rule as giving pizza delivery companies even more flexibility, letting them "reimburse a 'reasonable approximation' of drivers' expenses" instead of an amount based on records of actual expenses or an IRS mileage rate.  It does so after, on two prior occasions, taking the position that an approximation is insufficient to satisfy the anti-kickback rule and risks leaving employees paid less than minimum wage, which would violate the FLSA.  Please briefly offer some reasons, in this case, that a court might (1) find that the DOL is not entitled to Auer when it interprets its own rule as permitting an approximation of driver's expenses (instead of doing so based on records or IRS mileage rate about calculating delivery vehicle-related expenses) and (2) how, even if a court decided that the context of such letter justifies giving it Auer deference, a court could still reject the DOL's interpretation of its own rule here (even under an Auer deference framework)?
