Pаrt II: ESSAY QUESTIONS (ONE HOUR EACH)   ESSAY #1 (One Hоur)   Dаn is а pen cоllectоr with a penchant for fountain pens. Dan has been collecting pens for 25 years and has an extensive collection consisting of 450 fountain pens, 200 ballpoint pens, 120 glass dip pens, and 50 rollerball pens.  Pat makes custom fountain pens, i.e., fountain pens made to order.  Dan called Pat on the telephone and asked him to make a custom pen using materials that Dan saw on Pat’s website: (1) sky blue resin for the body of the pen; (2) titanium for the nib (or tip) and clip of the pen; and (3) a yellow diamond for the finial (or top) of the pen cap.  Pat told Dan the pen would cost total of $3,000 for the pen, where $2,100 was for the materials, and it would take 3 weeks to complete.  Dan agreed and told Pat to make the fountain pen.   Pat then went to his stockroom and found that he did not have any of the sky blue resin left.  When he called to order additional sky blue resin, he learned the price had doubled.  Pat underestimated the cost of the pen believing he still had sky blue resin in stock.  Pat immediately called Dan, told him of the situation regarding the sky blue resin, and asked for an additional $1,000.  Dan said “Okay, I really want that pen.  Do it.”   Next, when Pat looked for the titanium nib and yellow diamond, he found that he was also out of both materials.  Rather than ask for Dan’s permission, and wait 2 more months to get a yellow diamond from his supplier, Pat used a blue diamond which is worth $1,000 more than the yellow diamond originally ordered by Dan.  When Pat tried to order more titanium nibs, he learned his supplier had gone out of business.  Rather than ask for Dan’s permission, Pat just substituted a more expensive palladium nib (which costed $250 more than the titanium nib).   Pat delivered the completed fountain pen to Dan at the end of 3 weeks as promised.  Dan immediately rejected the pen: “This is not what I ordered so I am not paying for it.”   Dan sues Pat for breach of contract and specific performance. Discuss whether Dan will prevail, what Pat's likely defenses will be, and what kinds of remedies Dan could receive if successful.
