According to the FI card, Officer Sickly’s partner, Officer Healthy, was also present during the traffic stop that resulted in the conversation with the defendant that yielded the documented gang affiliation admission. After the defense objected to Detective Knowitall’s testimony, the prosecutor asked for a sidebar. During the sidebar discussion, the prosecutor maintained that Detective Knowitall could testify regarding the card given that he was designated as a Gang Expert. The defense attorney claimed that California law does not allow the designation of Gang Experts and that Detective Knowitall’s testimony was inadmissible. Following the sidebar, the Judge sustained defense counsel’s objection and the trial proceeded forward. The prosecutor then called Mr. Nye, an employee of the local police agency, to testify about ballistics evidence recovered at the crime scene. According to Mr. Nye, the test result that was the focus of his testimony was produced by a new technology that the police agency acquired approximately one year prior to the murder in this case. Mr. Nye testified that the technology was similar in many respects to older technology but incorporated several improvements that made it dramatically more accurate. He also testified that he was certified on the new technology and it was his understanding that several police agencies around the country used it as well. On cross-examination, the employee conceded that several major police departments around the country declined to adopt it for their agencies. As the end of Mr. Nye’s testimony, the defense attorney objected and moved to strike his entire testimony. The court sustained the objection. 1.
