Briаn is the heаd pilоt fоr а small charter cоmpany called "Skyward Airlines." On the day of the accident, he was scheduled to fly three passengers from Cincinnati to St. Louis. He loaded the passengers and checked the weight of the plane. The baggage weight was heavier than usual and slightly heavier than the airplane was supposed to carry, but Brian thought it would still be safe for the short trip because he had completed similar trips before with a plane slightly above the weight recommendation. The plane struggled during takeoff and barely lifted off the ground before crashing on the runway. Thankfully, nobody onboard was killed, but all three passengers suffered serious injuries. The passengers sued Brian for negligence. Brian explained that he had been flying for 15 years, he had plenty of experience flying small airplanes, and that even though he knew the plane was slightly overweight he didn’t think it posed a serious risk because he had flown planes much more over the recommended weight limits before without any problem. At trial, several other small airplane pilots testified that they would never fly a small airplane even slightly over the recommended weight limit and that they would have never mirrored Brian’s decision to attempt to fly with a plane as overweight as his was. Further testimony at trial from small airplane pilot instructors also reported that Brian’s decision to attempt to fly the overweight airplane is something that airplane pilots should never attempt to do under any circumstances. Based solely on the information presented, which is the most likely result at trial?
