Yоur client Gruffle Inc hаs аpprоаched yоu with regard to a potential brand dispute. Gruffle created a ride-sharing application in 2015.  It started in San Francisco, but quickly spread to New York, Los Angeles and other major US cities.  Word spread of it, and soon it had raised funding to be able to launch in other countries.  As it started in the US, the US lawyers applied for an International Registration based upon a US basic registration for the word mark GRUFFLE designating multiple countries (including the UK).  The specification of the International Registration (and its UK designation)  matches the US registration, and is as follows: Class 9: Mobile computer software applications for locating, hailing and booking taxi journeys In fact, the breadth of the service ecostructure is more complex:  whilst it is correct to describe it very simply in the way it is described in the US (and International Registration), it allows payments over the application; drivers who use the app often have a sign on their car, meaning users think these are the company’s drivers; they are investing in autonomous vehicle technology and are launching driverless taxi journeys; they have secured a special licensing deal with a major taxi manufacturer ROADIE to have a “GRUFFLE x ROADIE” co-branded taxi which has special technology making it easier to use as a taxi for those wanting to get bookings through Gruffle. The co-branded taxis have been announced but have not yet entered into service. Gruffle has been active in the UK since 2017 and has a very loyal fanbase.  The service has also been mentioned in lots of TV programmes, and most of the UK has heard of the service, even if they have not used it. Gruffle’s main competitor is Trundle, and there is substantial ill-will between the parties and they each fiercely compete with one another. Gruffle Inc has recently become aware of 2 concerning facts: A UK-based company called Sandbox Saloons Limited has obtained domain name registrations of the domain names GRUFLY.COM, GRUFLY.CO.UK and GRUF.LY; The same company has applied in the UK to register the mark GRUFLY for the following goods and services: Class 9: Computer software and hardware;  control apparatus; Navigation, guidance, tracking, targeting and map making devices Class 12: land vehicles Class 18: bags; umbrellas Class 25: clothing footwear and headwear Class 36: financial services Class 37: repair of vehicles Class 39: transportation services Class 41: education services; organisation of events This application was published last week for opposition purposes. Gruffle is currently unsure, but believes that this is an attempt by Trundle to cause Gruffle issues.  Research into Sandbox revealed that it was set-up in 2021 as “Company 1255677 Limited” with a company formations company as the sole director: it only changed its name the day before acquiring the domain names and applying to register the trade marks.  It now has one director, being one of the directors of the company formation company, and has a stated value of the shares of £10. Gruffle are unsure whether this is intended to block Gruffle from obtaining further rights, to force them to buy the rights of Sandbox at great expense, or to try to stop Gruffle.  They therefore ask for your help as follows:  To identify on what grounds you recommend any opposition be filed against the UK application for GRUFLY, and the extent to which you think the grounds apply (with reasons) To identify any further initial information required to be able to file any opposition To let them know the process once the opposition has been filed through to registration/end of the process (including appeals). To let them know of any further evidence you believe would be needed to hold the best success of winning the opposition Whether any court action can be pursued in relation to the domain names owned by Sandbox Saloons Limited (you should not address the details of any of the domain name dispute procedures)
