Just like clоckwоrk, Peggy’s аunt Dоrothy cаlled her the first Sundаy in April to remind her to come over to her house to help her get organized for her annual “Writer’s Conference for Historical Fiction.”  Dorothy was an author who had published several best-selling historical fiction books.  Each year, she told Peggy her primary purpose was to inspire new authors and provide tips for them breaking into the writer’s market.  Peggy always admired her aunt because she was so articulate and creative. However, she was also very messy and disorganized.  It was difficult for her to focus because she would often get distracted with a new novel idea that she immediately had to write it down.  Since Peggy was very organized and loved making lists, she had helped her aunt get ready for this writer’s conference for the past five years.  This year, Peggy (who was studying to be an accountant) told Dorothy she wasn’t sure she could come help her out this year because she was studying for the Uniform Certified Public Accounting (“CPA”) examination.  “What?”  Dorothy responded in disbelief.  “You know I cannot put on this writer’s conference without your help!  You know I appreciate and love you, my favorite niece!  You’ve been such a supportive niece and done all this work for me for free over the past several years.  Let me do something nice for you in return.  You probably need some extra money to take that CPA exam.  If you agree to help me out again this year, I will pay you $5,000 for the work you’ve done for me in the past five years and for this year in getting ready for this annual conference, including cleaning up the yard and pulling the weeds in the rose bushes by the circular driveway.  As a token of my appreciation, I will give you an extra $1,500 when this is all done.” Peggy agreed to Dorothy’s oral proposal.  She knew she would have to come up with the money to take the CPA exam, so helping her aunt again (this time for money) seemed like the obvious solution.  After she had finished organizing Dorothy’s house, Peggy started working on cleaning up the bushes and pulling the weeds in the rose bushes by the circular driveway.  However, she stumbled upon a bee’s nest and had to stop working.  When she called around for bee exterminators, the most affordable bee exterminator quoted her $350 to get rid of the bees.  Peggy called her aunt Dorothy and told her she would require an additional $350 for the bee extermination to continue her work cleaning up the yard and pulling the weeds in the rose bushes, Dorothy agreed, and Peggy started working again after the bee exterminator got rid of the bee’s nest. After the writer’s conference, Peggy sent her aunt Dorothy an invoice requesting total payment of $6,850.  When she received no response from her aunt, Peggy called her, and Dorothy refused to pay.  She apologized profusely and said that she didn’t have the funds because her turnout was lower than expected at the writer’s conference this year.  Although Peggy felt bad, she went ahead and filed a lawsuit against Dorothy because she had been counting on that extra money to help pay for the CPA exam.  Discuss the issues under Consideration and Promissory Estoppel only.
