Teresa was charged with illegal possession of cocaine and marijuana.The warrant that Officer Alex found during his computer search occurred because Teresa’s original speeding citation was sent to the wrong address by the court. When properly notified to appear, Teresa appeared in court, pleaded guilty, and paid a fine. The arrest warrant was ordered to be expunged by the judge. The clerk who had the duty to carry out the order to expunge the warrant from the computer negligently failed to do so. Thus, Teresa’s arrest by Officer Alex was invalid.Teresa has brought a pretrial motion to suppress the cocaine found on her person and the marijuana found in her car.How should the judge rule on the motion?
