Pаulsen оwns а smаll theater that shоws classic and secоnd run movies at discount prices. When a small retail place next door to Paulsen’s theater was vacated by a prior user, Paulsen got the idea to rent the store space and put in a sort of hobbies and collectables shop selling memorabilia, toys, books, posters, and plastic model kits related to the movies he was showing. Paulsen’s first week showing the Maltese Falcon while selling ceramic falcons, mystery novels, and pictures of the actors in the movie was a great success. The store made a profit of $500 for the week.  The second week, Paulson decided to show the World War two battleship movie “Sink the Bismarck,” while selling plastic model kits of the ships in the movie – Bismarck, HMS Hood, and others. Paulsen entered into a written contract with Duffy’s Hobby Wholesale (Duffy) for 200 model kits at $20.00 each for a total contract price of $4,000.00. Duffy also agreed to sell a one-of-a-kind large scale five-foot long display model of the ship HMS Rodney for $500 to Paulsen for use as a window display to attract customers. Delivery costs for the kits and the display model were $100. Paulsen paid for all of this in advance. The written contract contained a clause stating that if the kits or display model were not delivered to Paulsen by May 20, 2023, the week before the movie would run, Paulsen would be entitled to his money back and $4,000 in estimated lost profits. Paulsen planned to sell the model kits for $40.00 each.  The contract performance date arrived, but the model kits and the display model from Duffy did not. Six days went by with no word from Duffy. The day before the movie began, Paulsen contacted another wholesaler, Tripple Hobbies. Tripple Hobbies made an emergency rush delivery of 200 model kits that they sold to Paulsen for $30.00 each plus $200.00 for expedited delivery charges, but they did not arrive until the movie had been showing for three days. Paulsen sold 100 of the new kits from Tripple Hobbies for $40.00 each and is still trying to sell the rest. Paulsen thinks he would have sold them all if they had arrived before the movie’s first showing. Paulsen also thinks having the display model would have brought in movie business for the theater.  Paulsen wants to sue Duffy for damages and to require the delivery of the display model. Discuss.
