The defendant asked the victim if he would like to play a game involving a gun. To play, they would remove all but one bullet from the cylinder of the gun. The defendant spun the cylinder, pointed the gun at the victim’s head, and pulled the trigger. Nothing happened. The victim followed the same steps, and nothing happened when he pointed the gun at the defendant’s head. On the defendant’s second turn, the gun fired. The defendant exclaimed, “I’m sorry! I didn’t think it would shoot!” The victim died en route to the hospital.
