Adаm аnd Ben аre traveling vinyl windоw and dооr salesmen employed by Acme Corporation. One day while driving to a sales conference, Adam decides that it will be fun to drag race through a residential neighborhood in Anytown, USA. The posted speed limit is 25 miles per hour. Ben is a passenger in Adam’s vehicle. While drag racing, Adam reaches a speed of 75 miles per hour. Carl and Earl, neighborhood watch captains, see Adam drag racing and attempt to stop Adam’s vehicle by standing in the middle of the road and shouting at Adam to slow down. Upon seeing Carl and Earl in the middle of the road, Adam decides to hit Carl and Earl and accelerates to “teach them a lesson” reaching a speed of 100 miles per hour and destroying multiple mailboxes along the roadway. Ben encourages Adam to race toward Carl and Earl to “show them who is boss.” Carl and Earl become deathly afraid upon seeing Adam drag racing and attempt to move out of the way. Adam’s vehicle strikes a book in Carl’s hand. The force of the strike throws Carl on to the sidewalk where he is injured but does not die. Earl is unharmed. Adam and Ben see Carl fall on the sidewalk but do nothing. They decide to flee the scene to avoid missing their sales conference. Adam and Ben reach the sales conference where they set up a booth. At the sales booth, Adam and Ben hand out free samples of their vinyl product. Dan, the Acme Corporation sales manager, joins Adam and Ben at the sales conference where he sets up an alcoholic smoothie machine to incentivize attendees to stop at the booth. Adam suggests that they check IDs to make sure that visitors are 21 years or older before they are given an alcoholic smoothie. Dan overrules Adam, as a supervisor, worrying that this will discourage visitors, and instructs Adam and Ben not to check IDs for smoothie recipients. Adam and Ben later served an alcoholic smoothie to a 20 year old. After the sales conference Adam and Ben drive back through Anytown, USA. Ben is driving, and he makes a point to drive at the speed limit. Carl, who is sitting on his porch, sees Adam and Ben driving through the neighborhood. Carl is still bitter about Adam speeding through the neighborhood and becomes enraged at seeing Adam and Ben. Carl angrily grabs a gun and shoots at the vehicle, striking Adam and Ben. Ben is killed instantly, and Adam is permanently disfigured.         A local ordinance was passed last year which made it a criminal offense if a witness to an accident involving damage to property or injury to a person fails to call 911 to report damage or injury. Please discuss: Crimes, if any, that Adam, Ben, Carl, Dan, and Acme Corporation can be criminally charged? The criminal culpability of Adam, Ben, Carl, and Dan under the Common Law and the Model Penal Code for any crimes that they can be charged and any defenses they can raise to the charges.
