One dаy, Evа’s kids, Dаwn (age 10) and Frankie (age 5), were playing frisbee in their backyard;  Dawn accidentally threw the frisbee intо the yard оf their neighbоr, Pat.  So, Dawn slipped between the slats in the fence (which separated their yards), and retrieved the frisbee.  Without realizing it, she stepped on two of Pat’s heirloom tomato plants, crushing them completely. The next day, Pat went in her yard to check on her plants.  She was mad when she saw that two of her tomato plants were destroyed; it looked like someone had trampled on them.  Pat had paid $100 for each tomato plant. Later that day, Dawn and her brother played in their yard again.  Dawn accidentally kicked a ball into Pat’s yard.  Again, Dawn went through the fence, and into Pat’s yard, to get the ball.  This time she did not step on any plants. Unfortunately for Dawn, this time, Pat saw her and stormed outside.  She ran towards Dawn with her arms stretched towards Dawn,  yelling, “You’ll pay for this!”  Dawn froze in fear.  Pat grabbed Dawn’s ear and said, “I’m not letting you go until your mom sees what you did to my tomato plants!” Dawn, afraid to move, told Frank to “go get Mom quick!”  Frank got distracted and did not tell his mom to go help Dawn until about 30 minutes later.  Pat was holding Dawn’s ear the entire time, keeping her in Pat’s yard.  When Dawn’s mom came into her own backyard,  Pat let go of Dawn’s ear, which was now red and scratched from Pat’s firm hold.  Dawn immediately went to her mom.  Pat said, as she pointed to her damaged plants, “Your little girl came into my yard and stepped on my prized tomato plants, ruining them!”  Analyze what causes of action—other than negligence—Pat has against Dawn, including what damages, if any, Pat can recover. Do not discuss negligence or a parent’s liability for their children’s actions. Do not discuss defenses. What causes of action, if any, does Dawn have against Pat? Discuss.
