In 2027 Cоngress pаsses а piece оf legislаtiоn, overriding the President’s veto, that requires the President to get approval of the Senate majority and minority leaders, and the minority leader of the House and the Speaker of the House before any use of the US military against a non-nation state target. Intelligence agencies report to the President and the House and Senate leadership that a ship seized by pirates is now headed for the United States with a crew of terrorists for unknown purposes. It will arrive in ten days. The President consults the House and Senate leadership for approval of a strike on the vessel, but the leaders from the opposite party of the President refuse to approve of the use of any force against the ship or the terrorists on board. The President makes a speech explaining what happened and decrying the new legislation as unconstitutional interference with his role as Commander in Chief. The House and Senate leaders threaten to impeach the President if he has a military strike on the ship. An ordinary citizen, Peter Peterson files a suit in Federal Court in the District of Columbia seeking a declaration that the legislation is unconstitutional and enjoining the House and Senate leadership from taking any action against the President for any action against the terrorist vessel.
