Alex wоrks in а hоtel аs the night clerk. Ben, а hоtel guest, calls down to the reception desk and asks for instructions to lock the hotel safe because Ben planned to go out for an midnight hike. Approximately 15 minutes later, Ben walks by the reception desk and tells Alex that he will be back in a few hours. Ben asks Alex to watch his room because “a lot” of cash is in the room safe. Another hotel guest, Carl, is sitting at the hotel bar and hears Ben’s statement. After watching Ben walk out the door and around the corner through the window, Carl finishes his tenth drink and decides to take and permanently keep the money from the safe. At that moment, Alex falls asleep. Seeing that Alex is asleep, Carl goes to Ben’s room and breaks the door with a shoulder and enters with the intent to steal money from the safe. Carl quickly locates the safe but is unable to get the safe open before Ben returns. Upon hearing Ben open the door Carl escapes out the window. Under the City’s burglary statute any attempt to steal money from a dwelling is graded as a felony. Carl is quickly identified and arrested. At trial Carl claims that he was heavily intoxicated and therefore lacked criminal intent and that he suffered from the irresistible impulse to steal. Discuss: Whether Carl is guilty of the attempted or completed crime of larceny. Whether Carl is guilty of the attempted or completed crime of burglary. Whether Carl’s defenses of irresistible impulse to steal and intoxication excuse the conduct.
