The city оf Sаn Mаrcоs is in а state that was оnce part of Mexico; the city was built around a historic mission. As a result, some of the retail stores and other commercial buildings in the city were constructed in the Mission style of architecture, featuring adobe walls, large wooden beams, wrought iron railings, and red tile roofs. Most commercial buildings in the city, however, used the same architectural styles that would be seen in any other US city. Last year, the city council adopted a new ordinance which provided: “All new commercial buildings must be constructed in the Mission style of architecture.” The ordinance further required that the architectural plans for any new commercial building must be approved by a city commission before a building permit would be issued. Alana, an artist, wanted to build a new art supply store on a lot she owned in the city; her planned store would consist of a large red dome made out of shiny plastic material. After the commission rejected Alana’s plan, she brought suit against the city, asserting that the ordinance was invalid. Who will win the lawsuit?
