Pаuli оwns а cоmpаny that buys оld classic muscle cars, restores them to better than new condition, and sells them. Delacroix is a 22-year-old painter who paints art on cars. Pauli hears about Delacroix’s talent and wants to hire Delacroix to paint a scene on the side of a 1940 Dodge delivery van Pauli is restoring. Pauli invites Delacroix over to Pauli’s shop to make Delacroix an offer. While at the shop, Delacroix sees a 1951 Hudson Hornet that Pauli has completed except for the paint. Pauli says to Delacroix: if Delacroix will paint the scene on the van for Pauli, Pauli will sell Delacroix the Hornet at a major discount, for $40K. Unpainted, the car is still worth $50K, which would include a $10K profit for Pauli. Delacroix is willing to agree but does not have that much money and his income is irregular. Some weeks Delacroix will make $10k and some weeks he will make nothing. Pauli suggests that if Delacroix will agree to paint art on six vehicles, over the next two years, Pauli will let Delacroix take the Hornet. But Pauli says that if Delacroix does not perform, Delacroix will owe Pauli $60K. Pauli also calls Delacroix’s mother, who agrees on the phone that she will guarantee the purchase. Delacroix drives home in the Hornet. Pauli sends Delacroix a letter that states: “This is to confirm our deal. I am selling you the Hudson Hornet and you will paint art to my specifications on six vehicles during the next two years or you and your mom owe me $60K payable on demand.” The next day, Delacroix begins work on the delivery van project and finishes in three weeks. Four months later, Pauli has Delacroix paint a sunset on the side of a sedan. Four months after that, Pauli asks Delacroix to paint a 1966 Volkswagen beetle. 13 months after the initial purchase, Pauli asks Delacroix to paint the sides of a 24-foot moving van with a scene of the Grand Canyon. Delacroix agrees and starts the project, but after five months of painting, the moving van is still not done and an exhausted Delacroix loses heart and quits working on the enormous project. Pauli asks Delacroix to come back and keep painting but Delacroix does not. Delacroix does paint art on the Hornet, adding $20K to its value. 25 months after Delacroix drove home in the Hornet, Pauli sued Delacroix and Delacroix’s mother for breach of contract. What remedies are available to Pauli and is Pauli likely to obtain any of them? You do not need to discuss whether there was an offer, acceptance, or consideration.
