Bоb, Ted, аnd Alice liked tо surf much mоre thаn they liked to work. On one Sаturday afternoon, they were having lunch at Nick’s Beach Burgers. Bob observed how the fast-food restaurant was always crowded with people and probably “raked in a ton of cash.” Bob then conveyed to his friends a plan of action that would help subsidize their surfing. He explained how he noticed that every day at 4 pm, one of the restaurant employees would walk down an alley with a bag leading to a street where Surf City Bank was located. Bob put two plus two together and surmised that the bag was full of money. He proposed that they would follow the employee with the money bag the following Friday. The idea was for Alice to stop the employee and ask her for directions. Ted would then flash an unloaded gun and Bob would grab the bag. The three of them would then walk away. Alice immediately responded that “this could be a crime.” Ted voiced similar reservations. Yet Bob persisted in his appeal and added that “this is a quick buck and nobody gets hurt.” So Ted finally agreed to the proposal and Alice nodded her assent to the plan. However, on Wednesday of the following week, Alice decided that she didn’t want any part of the planned heist. At the same time, she decided not to say anything to Bob or Ted because she feared they would try to talk her out of her decision. When Friday finally arrived, Bob and Ted were waiting behind the restaurant, but Alice was nowhere to be found. Ted tried several times to call her but kept getting her voice mail. Nevertheless, when the restaurant’s employee emerged with the bag, Bob and Ted followed her into the alley. However, things did not go according to plan. When Ted displayed the gun and demanded that the employee give them the bag, she began to scream and clutched the bag with both hands. The alley soon filled with beach goers and Bob and Ted were apprehended. Discuss all legal issues regarding: (1) the proposal by Bob; (2) the agreement to the plan; (3) the execution of the plan; and, (4) the criminal responsibility of Alice. Assume that the common law applies in this jurisdiction.
