One night, Dаve аnd Pаul were hanging оut at a spоrts bar.  Dave says tо Paul. “I bet I could beat you at arm wrestling.” Paul replies, “Let’s find out.”  After they arm wrestled for awhile, Dave pokes Paul in the eye in order to distract him, so that Dave can win.  Paul was so focused on the arm wrestling, that he never saw Dave’s finger coming until it hit him in the eye. Paul quickly stood up as a reaction to the pain in his eye, accidentally spilling his drink on Patty, a lady walking by their table.  The drink stained Patty’s suede jacket; Paul said, “I’m sorry.  I didn’t mean to spill my drink on your jacket.” The cost of repairing the jacket is $200. The cost of replacing the jacket is $500. Wanting to avoid further confrontation, and seek medical attention for his eye, Paul starts to leave the bar, forgetting to pay his bill.  Manny, the bar manager, stops Paul by grabbing his arm, exclaiming, “You’re not leaving until you pay your bill!”  Manny then escorts Paul to a back office where he closes but does not lock the door.  Manny keeps Paul there for 15 minutes, talking to him about what happened and why he started to leave without paying. Manny reviews Paul’s tab and asks him to pay for his purchases, which he does.  Paul was eager to leave to get help for his eye, but he also wanted to clear things up with Manny, and pay the bill. Discuss the questions below. Discuss each element of all likely tort claims. Use the facts to prove or disprove each element of each tort.  Discuss each tort separately and remember to use the IRAC Format. Do not discuss negligence. Does Paul have any valid tort claims against Dave? Does Dave have any valid defenses? Does Patty have any valid tort claims against Paul? Does Paul have any valid tort claims against Manny? Does Manny have any defenses or privileges?
