One day, little Cody’s dad tells Cody to join him so that the dad can show Cody the nature of salesmanship. Cody’s dad successfully makes a sale of a set of kitchen pans to Caroline for $150. During his sales talk with Caroline, Cody’s dad told Caroline, “this is my son, Cody, who has nearly graduated . . . . from kindergarten.”  Little Cody smiled but said nothing at all, while playing with a small toy and occasionally holding a display sign for his dad.  Three months later, Caroline sees Cody riding his bike past her house and she screams for him to stop. Caroline tells Cody how much she loves her kitchen pans and how she wants a set for her sister. Cody says nothing. Caroline gives Cody $150 to place the order. Cody still says nothing. Months go by and no pans are delivered to Caroline. Outraged, Caroline calls Cody’s dad, only to learn that he has no such order for her. Caroline demands a refund of $150. Is Cody's dad liable to Caroline for the $150 Caroline presented to Cody?
