The men did not listen to Joe, but instead jumped in the truck and started to speed away. Joe realized he was about to lose a lot of valuable equipment, so he started shooting at the men as they drove out of his driveway.  Two of the three men were in the bed of the pick-up truck with the tools and equipment, and the other man was driving.  Joe is a good shot, and his gunfire killed one of the men in the back of the truck, and injured the other.  The driver was unharmed.  In this case, Joe’s use of deadly force to protect his property was:
