Maya tells Jordan that if Jordan agrees to a sexual relationship, she will guarantee Jordan a promotion to senior project coordinator and assign them to the company’s highest-paying client accounts.   Jordan refuses and reports the conduct to Robert,  another supervisor, and Human Resources. Robert dismisses the complaint, stating Maya has significant authority and suggests that Jordan should “work it out informally.”   Human Resources acknowledges the complaint but delays any investigation. After the report, Maya’s conduct continues. Jordan is removed from key projects without explanation, excluded from meetings they previously led, and given increasingly negative performance feedback. Coworkers begin to distance themselves from Jordan, and Jordan believes the treatment is connected to the complaint. The company does not take timely or effective action to address the situation.  Jordan ultimately resigns and files a lawsuit against BRD. #1  Explain whether Jordan is an independent contractor or an employee and why? Make sure to state the legal test that is used.  (10 points) #2 Assume that Jordan is an employee.  With that assumption in mind, list what laws apply to the Jordan v. BRD  lawsuit. (20 points) #3 Assume that Jordan is an employee.  With that assumption in mind, please explain whether Jordan be successful in their lawsuit against BRD? Why or Why not?  Please apply the law to the facts.  (40 Points) #4  What case applies to the Jordan v. BRD   lawsuit?  In your answer explain why the case applies.  Remember to only cite a case discussed in the lecture videos. (20 points).
