Bill is а citizen оf Cаlifоrniа and is married tо Dawn. Peter is citizen of Arizona and is a well-renown general contractor. Peter holds a California State Contractor’s license in addition to one in Arizona. In June of 2024, Bill hired Peter to remodel the kitchen of his house. After the work was completed, Bill claimed that Peter used substandard materials and that the workmanship was defective. As a result, Bill hired Art to fix and complete the kitchen remodel. In January of 2025, Bill sued Peter in the Federal District Court in the Central District in California for breach of contract in the amount of $95,000 which also included the amount Bill paid to Art. The case proceeded to a bench trial and judgment was entered in Bill’s favor in the amount of $95,000. In December of 2025, Peter sued Bill’s wife, Dawn, in the Federal District Court in the Central District of California for non-payment of the remodeling contract. Dawn filed an answer to the complaint and raised the affirmative defense of claim preclusion. During discovery, Dawn served a demand for production of documents to Peter that requested the names, addresses and phone numbers of all of Peter’s customers for the past ten years. It was Dawn’s contention that other clients of Peter’s had made the same complaints for shoddy workmanship. Peter’s attorney objected to the production demand on the grounds that the information is not relevant. Dawn filed a motion for summary judgment against Peter on the grounds that Peter’s breach of contract claim against her is barred due to claim preclusion. Dawn also filed a motion to compel Peter to produce the names, addresses and phone numbers of all of Peter’s customers. For the purposes of this question, assume there is valid personal jurisdiction and subject matter jurisdiction and that the Federal Rules of Civil Procedure apply. DO NOT WRITE ON CALIFORNIA LAW!
