The group who call themselves the Red Brigade demand the release of political prisoners held by State X. State X requests State Y to take action against the hijackers but State Y refuses to cooperate with State X. State X then carries out a daring rescue mission to free its citizens held hostage in the plane without the permission of State Y. The mission to rescue the passengers is successful. This incident raises the following question.   1,Which state or states has jurisdiction in this case which involves hijacking of an airplane? 2.What jurisdictional principle can be used to assert jurisdiction in case of hijackings? 3,What is the duty of State Y under the Hague Convention on Unlawful seizure of aircraft (1970)? 4. On what legal grounds can State Y object to the unauthorized rescue mission carried out by State X? 5. On what legal grounds can State X justify the rescue mission that it carried out?           2.Iraq invaded and occupied Kuwait in August 1990. The UN Security Council passed several resolutions imposing sanctions on Iraq and finally authorizing the use of force. Subsequently in the Gulf War of 1991 the US led coalition and Iraq fought a war. During the war Iraq used civilians as human shields to protect military installations.   1.Which state was responsible for violating Article 2.4 of the Charter and principles of jus ad bellum ? Why? 2.Was Kuwait legally authorized to use force under Article 51 under these circumstances? Why? 3. Was the use of force by the US led coalition legal according to the laws of war? Why? 4. If either side had initiated the use of weapons of mass destruction such as chemical or biological weapons would it be a breach of the laws of war? Why? 5.If air attacks by the coalition forces, unaware of the presence of civilians, on the military installations led to civilian casualties which side is liable for violating the Geneva Convention (1949)? Why?
