Pink оwns аnd оperаtes а tоur guide service, Pink’s Tours. There are several different tours of the downtown area of the city where Pink lives. One of the most popular is the donut tour. In this Pink takes a group of people to ten different donut shops. At each there is a story about something that happened at the shop, about famous regular patrons, about how it got started, or about the owner. At each shop the group gets half a fancy custom donut for each person. Pink charges each person on the tour $20. This is not a bad deal, as buying the donuts each person consumes, on their own, would cost $20. The donut shops give Pink the donuts for free as a promotion of their shops. The average number of people on the tour is six. The tour runs Monday through Friday. Danna was an actress famous for appearing in a popular television show in the early 1970’s. Now a senior citizen, she no longer appears on television or in the movies, but still has a fan following, especially among baby boomers. Nevertheless, Pink observed Danna felt lonely. Danna lives in the same apartment building as Pink. Pink wants Danna to work for him and be part of the tour. He carefully watches for when Danna is leaving or arriving and goes into the common hallway so he can run into her. He gradually gets to know her. Pink begins bringing her little gifts and doing favors for her. Pink convinced her that he cared about her more than most of her other friends. He also discovered some of her secrets. Danna abuses alcohol and is having an affair with a married woman. Pink thinks if these things were discovered by the press they would alienate much of her remaining fan base. Pink tells Danna that he really cares about her and wants to help her and protect her by keeping her secrets, but if he does not get help with his tour business he will have to move out of the building and stop helping her. Pink admits he might feel tempted to sell her secrets. Pink asks Danna to help him make more money. Pink and Danna enter into an oral contract that for $20 each tour, she will appear in the last donut shop on the tour for at least 10 minutes, once a week for the next eighteen months. Danna must talk to tour members who want to talk to her. She must be friendly. She is allowed to ask for money in return for her autograph. Danna must greet Pink and flirt with him when the tour group arrives at the donut shop and say she will spend ten minutes with the tour group because Pink is leading it. In this way Pink hopes those on each tour will spread what happened by word of mouth and make the tour more popular. It works. After two weeks the average number of tour customers rises to 10. Many tell Pink they are taking the tour hoping to get a glimpse of Danna. After another month, Danna complains to Pink that she is weary of the donut shop appearance and is going to quit doing it. Pink tells Danna he will kill himself unless she continues to do the appearances. Danna continues the work for two more appearances. Then she quits doing them and moves to another part of town. Pink sues Danna for breach of contract. Discuss.
