The pоlice cаlled Zаbel tо а lineup shоrtly after Zabel witnessed a crime. Zabel identified Tina as the perpetrator and Tina is now a defendant in a criminal trial in California state court. The following happened during the trial: Prosecutor: "Were you asked to come to a lineup to identify the person who committed the crime that you just testified you witnessed? Zabel: "Yes." Prosecutor: "When did this lineup happen?" Zabel: "Just a few hours after the events happened that I testified about earlier." Prosecutor: "Were the events that you saw and the appearance of the person you saw who committed those acts fresh in your mind at that time?" Zabel: "Yes." Zabel then testified that he told the police at the lineup that the defendant was the person he saw commit the acts that were the subject of his earlier testimony about what he saw and experienced. The defense lawyer objected on the grounds of hearsay.

One оf her best skills was the “Daniel Cut‘n Flip,” a new technique he developed whereby a chef can cut a food item and simultaneously flip it into a bowl. This technique is complicated and hard to understand merely by observing it. While demonstrating this technique, Chef Danielle spoke constantly, explaining with precision every step of her technique while the students watched with great interest and took detailed notes (as all good students do). One of their statements was that “If you twist your wrist in this way, the technique can be quite dangerous. This is because the food items fly uncontrollably with great force.” As they demonstrated this potential problem, a piece of carrot flew off the flashing blade and hit a student in the eye, causing a painful injury. The student sued Danielle. The student's lawyer called a classmate to testify to Chef Daniel's statements during trial.
