Officer Bob gave Anna $20 in cash and told her to enter the gas station and purchase a bottle of beer and a package of the gummies. Anna entered the gas station during normal business hours and looked around for a few minutes trying, without success, to find the CBD gummies. While Sam was distracted with other customers, she opened a door which had a sign saying “Employees Only” and snuck into the storage room. She found packages of gummies sitting on a shelf, that she knew from her friends were over the legal limit, and put one in her pocket. She then returned to the refrigerator aisle, selected a beer, and went to the register where she purchased the beer. Sam accepted the cash without asking for an ID. Anna left the store and promptly returned to Officer Bob and gave him both the beer and the gummies. Officer Bob sent the gummies to the lab which revealed that the THC concentration was, in fact, far above the legal limit. Officer Bob then returned to the Zeus Goose and charged Sam with selling alcohol to a minor and possession of a controlled substance with the intent to distribute it. Sam has filed a motion to suppress arguing that Anna’s entry to the store and her sneaking into the storge room constituted an unlawful search by law enforcement. The State concedes that Anna was an agent of law enforcement at the time and was subject to constitutional requirements, but argues that her actions did not constitute a search.
