Pаt аnd Del аre neighbоrs. They were friendly with оne anоther, One afternoon Del knocked on Pat’s door. Del said her car would not start and asked if Pat would take her to a job interview a mile or so away. The interview would start in a half hour, so time was critical. Pat said she could not because she was in the middle of baking a souffle and could not leave it or stop. Del asked if she could borrow Pat’s car. Pat reluctantly agreed and handed Del the keys. Pat said “Please come back as soon as possible. I am supposed to bring this souffle to a dinner my boss is putting on in two hours.” Del took the keys and headed for the car. Del drove the car to the interview and spent about an hour in the interview. After Del came out of the interview, she remembered that she had not been shopping and was out of milk. She decided to stop by the store and pick up some groceries. An hour later Del was loading the back seat of Pat’s car with groceries. Del could not put them on the floor because the floor was already covered with a fruit tray and a sheet cake. Del supposed they must also be for the dinner Pat was to attend. Del felt cold and decided to borrow the sweater. After putting on the sweater Del went to Pat’s front door and rang the bell. Pat came to the door and was very agitated. “Where have you been? Quickly, give me the keys. Help me carry this food our to the car please.” Pat handed Del a warm casserole dish and headed for the car with the souffle. When Pat saw the interior of the car, she was furious. She started yelling at Del. Then Pat noticed the sweater and demanded it back. Del, still holding the casserole, panicked and turned and ran toward her front door by the closest route, through Pat’s flower garden, crushing several small plants. Del tripped, falling forward and landing on the casserole. The sweater was badly stained. What intentional torts can Pat sue Del for? Would Del have any defenses? Discuss.
