Questiоn 1 – 10 Pоints Cаpitоl Climb, LLC operаtes аn indoor rock-climbing gym in Madison, Wisconsin, and sells day passes and memberships to the public. The gym uses automatic belay devices (“auto-belays”), which catch climbers and lower them slowly to the floor if they fall or let go of the wall. The auto-belays were purchased from VertiTech, Inc. Each device is connected to VertiTech’s maintenance app. The app sends an alert to gym management when a device reports a “retraction fault,” and the manufacturer’s written instructions require that a device displaying a retraction fault be removed from service immediately and, in all events, before it is used again.  On a busy Saturday during a half-price promotion, the app flagged the auto-belay on Wall 7 with a retraction fault. The manager on duty was short-staffed. She dismissed the alert on her phone and decided to “deal with it Monday,” so Wall 7 stayed open. Capitol Climb painted a marked “Waiting Zone” on the floor about six feet from the base of each wall, where customers line up for their turn to climb. That afternoon Jordan Reyes, a day-pass customer, climbed Wall 7. When Jordan let go at the top, the auto-belay failed to engage properly. Jordan dropped nearly 20 feet and landed on Priya Shah, a customer standing in the Waiting Zone. Priya suffered a fractured pelvis and a concussion. Capitol Climb argues that Priya was not even climbing, so it owed her no duty with respect to the auto-belay. REQUIRED – 10 Points: Will Priya prevail in her negligence lawsuit against Capitol Climb? In separately lettered or numbered paragraphs, discuss each element of Priya’s negligence claim. DO NOT discuss any claims against VertiTech or Jordan.
