Offer Mаrtinez hаs been аn оfficer fоr 25 years. She  is cоnsidered a firearms expert because she  has obtained special training and education on handgun recognition. She  has over 20 years of experience identifying firearms and other weapons from her hundreds of street encounters recovering guns.  Officer Martinez has been patrolling this particular high crime area for over 10 years.  About 1 a.m. she and her partner are on patrol.  She observes  Pete pacing back and forth  in front of a closed cell phone store and continually looking up and down the street.  Suspecting Pete may be about to break into the store, She and her partner approach Pete and she  commands Pete to “Stop!” Pete who was walking in the opposite direction obeys the command. He stops. She stands in front of Pete and her partner stands to Pete’s left with his gun drawn. As she begins to ask Pete questions about his identity and why he is at the location at this time of night, Pete gives nervous and evasive answers. Officer Martinez then notices a distinct angular bulge in Pete’s front pocket. She thinks it may be a gun. Fearing for her safety, Officer Martinez pats down Pete’s pockets and based on her training, education and experience recognizes the barrel and trigger guard of a small handgun. Also, the object feels hard and heavy.  She reaches into his pocket and takes possession of the gun. She also obtains Pete’s driver license showing he is 15 years old.  Officer Martinez is aware of the law which states that [1] a minor [2] in possession  [3] of a handgun or firearm is guilty of a Felony.  Officer Martinez arrests Peter for Felony gun possession. Pete’s lawyer asserts his rights were violated under the 4th Amendment and asks the court to apply the exclusionary rule to suppress  the recovered firearm.  Discuss the legality of the initial stop, frisk and arrest. Will the court grant the defense motion?

After being аrrested fоr murder, the pоlice hаndcuffed Rоbert аnd took him to the police station. He was placed in the interrogation room at 1:15 a.m. The interrogation room was small and windowless. The lights were kept at full brightness, and the room temperature was kept at 50 degrees. There was no access to a phone or the outside. Robert was not given a jacket or a blanket. That is what God would want you to do." Feeling spiritually convicted, exhausted, cold, and concerned for his family, Robert confessed to the murder. Robert's Lawyer moves the court to suppress his statement solely on 5th Amendment Due Process grounds. Discuss.
