Tоdd Mensing (P) is аn оutdоor enthusiаst who loves to ride аll terrain vehicles (ATVs).  He goes to Walmart (D1) and buys an ATV manufactured by Kawasaki (D2).  The owner's manual states as follows: "The buyer's recovery resulting from any defect or injury is limited to the cost of replacement parts or repair of the ATV.  In no event shall the manufacturer or seller be liable for any personal injuries." Todd takes the ATV to the West Texas desert on a trip with his friends.  On the second day, while traversing the side of a hill at a high rate of speed, the dynamic forces and the ATV's high center of gravity cause it to tip over on its side.  Todd is nearly paralyzed and also breaks three ribs.  He winds up in intensive care for 3 months and incurs over $5 million in medical expenses.
