Adаm is the оperаtiоns mаnager fоr Events, LLC, a company that coordinates large-scale outdoor music festivals and corporate events. The owner, Pete, left Adam a note stating: “Adam, please purchase the following items for the company’s upcoming events: 1) 15 industrial-grade portable generators of brand X; 2) 10 large event tents, each costing no more than $100; and 3) 25 VIP restroom trailers with built-in sanitizing stations with premium chemical treatment tanks. Thanks, Boss Pete” Adam contacted a supplier and told the sales representative he was Pete’s agent and needed 15 brand X generators. The representative said that brand Y was in stock and very similar but much cheaper. Without confirming with Pete, Adam agreed to buy 15 brand Y generators and signed the contract as Pete’s agent. When the units arrived, Pete rejected them and refused to pay. Adam contacted a tent rental company and signed a contract in his own name to buy 10 tents at $90 each. He did not tell the company he was acting on Pete’s behalf. The tents were delivered, but Pete decided to cancel the events, so he refused to pay for them. Adam contracted with a manufacturer for 25 VIP restroom trailers with sanitizing stations but without the premium chemical treatment tanks Pete had specified. He told the manufacturer he was acting for a company but did not disclose Pete’s name. Pete used the trailers anyway but now refuses to pay the manufacturer. Assume valid contracts were formed. Who is liable on each of the contracts above? Discuss fully.
