The FBI recently becаme cоncerned аbоut numerоus tips from congressionаl staffers that bribery and corruption was occurring in the House of Representatives. The FBI decided to test these tips by setting up an elaborate sting operation. Using assets seized by the DEA from drug kingpins, they created a fictional scenario to catch corrupt congressmen. First, the FBI took a seized mansion in the Caribbean and refurbished it to look occupied. They staffed it with agents posing as servants, drivers, maids, cooks, and the like to ensure that every guest interaction would take place between the suspect and an agent. Then, they brought in a member of their Middle East team who spoke fluent Arabic and had him pose as an Oil Sheikh who was looking to open a drilling operation in a national park where drilling was prohibited. Over the next several months, this fake Sheikh sent invitations to every member of congress, inviting them to stay at his resort and to discuss business. Congressman Carl was one such invitee. When Carl arrived, he was treated to a lavish dinner with the Sheikh. During the dinner, the agent posing as the Sheikh offered Carl $1 million cash if he would vote for an exception that would allow him to drill in the national park. Carl said that he would accept the offer if he could spend the night with some of the ladies serving the dinner. The Sheikh agreed and had his assistant hand Carl’s aide a briefcase full of cash. The agents posing as servers then switched to only non-alcoholic drinks, but Carl seemed to not notice. After the dinner, Carl was taken to his room by two undercover agents posing as servers. While walking there, he bragged about how powerful he was and how trips, bribes, and services like this were what a man of his position and influence deserved. The agents asked him about other times where this had happened and Carl talked about multiple other bribes he had received in similar situations. Once the agents got Carl to his room and away from his security detail, they identified themselves as FBI agents and placed him under arrest. The FBI later corroborated his statements to the agents and Carl was charged in Federal Court with multiple counts of accepting bribes. Carl has moved to suppress the indictment for the bribery at the resort arguing that it constituted entrapment, and has argued that the statements to the FBI agents, as well as the evidence that came from those statements, should be suppressed because he was intoxicated and so they could not have been voluntarily made.
