You will not get extra points for answering all of them. Each questions worth 20 points. So this session worth 60 points altogether.  Once you choose the questions you want to answer, please state clearly the one you want answer following with your answers.  Question 1: Please define “terrorism.” Your definition should not merely be a recitation of other definitions discussed during the course, but should be a definition that you believe best describes terrorism. You must explain WHY you believe the definition you choose best describes terrorism. You should incorporate other definitions of terrorism where appropriate and may criticize definitions that you believe do not full describe terrorism. Please provide a detailed explanation for this definition.   Question 2: What legal guidance would you provide the President of the US (POTUS) regarding detention by US military personnel of an individual suspected of involvement in terrorism (the detention did not occur in the US)? In answering this question please consider: Limits of Interrogation   Appropriate Judicial Forum/s for trial; (i.e. Military Commission; Article III courts; National Security Courts) Does your answer change if the person is a US citizen or not, and how?  If not, why not? What are the geo-political ramifications and justifications for this decision?   Question 3: Please explain the significance of the following in terms with respect to operational counterterrorism: Proportionality; Collateral Damage;   Non-state Actor; Military Necessity;   Anticipatory self-defense   Question 4: On your first day as Assistant General Counsel to the CIA, you receive an urgent cable from a CIA employee, code named “Gus”, in western Afghanistan.  Gus informs you that within the past hour, a group of either Al Qaeda or Taliban terrorists ambushed a NATO military convoy in Herat and killed four American soldiers. Coalition forces pursued the terrorists to the border of Iran, where the coalition troops stopped for fear of inflaming the Iranians.  Gus tells you that he has a highly placed source, code named “Colonel Smith, ” in the Iranian Boarder Guard. Colonel Smith just telephoned Gus to say that the terrorists have holed up in a safe house in the eastern Iranian city of Mashhad.  Gus has been provided with precise coordinates and photographs of the safe house. He asks you to outline the legal implications and restrictions of the following three operational plans: (i)    A strike on the safe house with missiles fired from an Unmanned Aerial Vehicle (UAV); (ii)   Insertion of a CIA covert team into Mashhad for the capture of the terrorists, to be followed by interrogation by the CIA; and (iii)  Payment of $1 million to Colonel Smith for the arrest of the terrorists by members of the Iranian Boarder Guard and ultimate rendition to the former Soviet state of Moldova, which is an American ally in the “Global War on Terrorism” and is renowned for its brutal methods of torture and coercive questioning. What additional information would you like from Gus before signing off on any of these plans? Assuming that no additional information is forthcoming, which of these three options would you most likely to approve?
