Each question requires at least a two to three paragraph response (approx. five to seven sentences each). You may choose three of the four questions to answer. Make sure to note which response is for which question. Each question is worth 10 points. A. Define obscenity. Then, articulate the history of this free speech topic by introducing two cases from Supreme Court history that created or introduced new precedent. Lastly, how is obscenity different than indecency? B. Define the legal concept of scrutiny. Then, describe the three levels of scrutiny, laying out what the government must prove to win in each case. Finally, identify one case where scrutiny was established. C. Define what a public forum is. Then, describe the three different types of public forums, providing specific examples of each one. Finally, identify one case in which the public forum doctrine was used. D. Define the concept of incitement.
