Marcus was driving down Main Street one day after work. It was raining heavily and Marcus drove 5 mph below the speed limit. Just before coming to the traffic light at Stanley Street, Marcus got a text alert on his phone. He pulled the phone from his pocket and looked down at his lap while unlocking the phone and reading the text. Unfortunately, this means he did not see the light turn red and his car entered the intersection. Juliana was driving down Stanley Street, and despite the rain she was going about 15 mph above the speed limit. When she saw Marcus run the red light, she attempted to brake and swerve out of the way but wasn’t able to, and her car hit Marcus’s car. Marcus and Juliana each sue the other for negligence.
