Dino-Ribs, Inc. (DRI) is a nationally recognized wholesaler of beef ribs for restaurants. DRI is both incorporated and headquartered within the state of Texas where it sells & ships large quantities of its giant beefy ribs to fine dining establishments located in all 50 states. Bill’s BBQ Emporium, Inc. (Bill’s BBQ) purchases its ribs from DRI. Bill’s BBQ is both incorporated and headquartered within the state of Oregon, and its many restaurants are found in both California and Oregon. Bill’s BBQ doesn’t advertise in California or operate a website but a large proportion of its customers are California residents who heard about it due to word-of-mouth reputation. Bill’s BBQ also purchases most of its food and equipment supplies from California businesses. Peter, an elderly gentleman and resident of California, was on vacation in Oregon and decided to eat at Bill’s BBQ. While dining there, Peter indulged in a huge portion of Dino Ribs and became very ill. Bill’s BBQ purchased the ribs from DRI. Peter had to postpone returning to California by about one week due to his need to recover before traveling home. Now home and feeling better, Peter seeks to recover for his medical bills and pain & suffering caused by the bad ribs. Additionally, Peter is quite frail and his only income is a modest pension.
