Al, Bill and Carl worked together in a tree trimming business.  Al had placed a bid on a job relating to the property surrounding a local bank. While there, he noticed customers entering the bank with money bags.  When Al received news that the bank had approved his bid, he called Bill and Carl with a plan on how they could get a bonus on this job.  He proposed that they would finish their work by mid-morning and then wait until a vulnerable cash carrying customer was seen walking across the bank’s parking lot.  Bill expressed reservations about the plan because he had two previous felony convictions and if they were caught his third strike would result in a mandatory minimum sentence.  Nevertheless, everyone finally agreed to Al’s proposal and decided that Bill would return home after the tree trimming was finished and take a lesser cut from the proceeds of their caper. The following Monday morning the three men arrived around 6 AM and finished their work by 10AM as planned.  Soon after Bill had left for home, an elderly man exited his car in the lot carrying two large money bags.  Armed with machetes, the two men made their move.  However, as they approached the elderly man, a private security guard inside the glass doors of the bank saw what was going on and immediately ran towards them.  Al then signaled to Carl to turn away, and they both walked past the elderly man. However, it was too late for them to avoid detection.  The private security guard removed his revolver and ordered them to stop and to drop their weapons.  They complied with his order.  The police were called immediately, and Al and Carl were placed under arrest. Discuss all legal issues relating to (1) the proposal by Al; (2) the agreement to the plan (3) Bill’s criminal responsibility; (4) the execution of the plan in the bank parking lot; (5) the effort by Bill and Carl to avoid detection.  Assume the common law applies in this jurisdiction.
