One Spring, I hire a local craftswoman, Julia, to make me a beautiful, hand-carved wooden stand-up paddleboard.  We agree on a price of $900, which I’ll pay when I receive it.  The paddleboard will be worth $1700 to me.  Before she is done making it, however, her woodworking tools get stolen out of her Jeep, and she tells me she’ll be unable to complete it. When we agreed to the contract, another local craftsman was offering to make me a smaller paddleboard for $750, which I would have valued at $1300; this late in the season, however, nobody is offering a paddleboard I’m interested in buying. Calculate expectation damages. Calculate opportunity cost damages. Julia argues she shouldn’t owe damages, because performance became impossible. Who do you think was the efficient bearer of the risk that her tools get stolen?  Why?  Based on that, should Julia owe me damages or not? Julia could have moved her tools out of her Jeep and into her house each night, to make it less likely they’d get stolen, but that would have required more space in her house and more effort each day. Would moving her tools inside overnight have been a reliance investment, an investment in performance, or a penalty default? Which remedy for breach – expectation damages, opportunity cost damages, or no damages – would have given Julia exactly efficient incentives for actions like moving her tools indoors overnight? After signing the contract with Julia, in anticipation of receiving the paddleboard, I paid another local artist $500 for a beautiful wooden paddle that would match the paddleboard; this would increase my value for the paddleboard from $1700 to $2800, but it would be worthless in the event I bought a different paddleboard.   F.  How would you determine whether my investment in this paddle was efficient? (What would you need to know, and how would you use that information?)  G. To create an incentive for the efficient level of investments like this, should they increase the damages I’m entitled to if Julia fails to deliver the paddleboard, or should the damages stay the same?
