Task: Explain the reasoning used by the Supreme Court in the case Dobbs v. Jackson Women’s Health. Why was it constitutional for the state to limit access to abortions?  Response: In Dobbs v. Jackson Women’s Health Organization (2022), the Supreme Court upheld Mississippi’s 15-week abortion ban and overruled Roe v. Wade and Planned Parenthood v. Casey. Justice Alito’s majority opinion reasoned that abortion is not protected by the Constitution because the document does not explicitly mention the right. On that view, unless a right is expressly written into the constitutional text, courts may not treat it as constitutionally protected. The majority therefore rejected Roe’s viability rule and Casey’s undue-burden standard, holding that abortion laws are valid if they satisfy rational-basis review. The joint dissent by Justices Breyer, Sotomayor, and Kagan argued that Roe and Casey should remain in force because of precedent. The dissent maintained that a broad social consensus had emerged in support of abortion rights, making the Court’s reversal especially unjustified.
