If an employee is terminated due to misconduct, a process needs to be started by the labor board to hold a hearing to assess the amount of severance pay or penalties the employee owes to the employer. This process starts when a clerk at the labor board receives a claim for damages from the employer. The clerk then retrieves the employee’s case file and checks that the claim is both eligible for processing and aligned with the employee’s contract terms. After these checks, the clerk needs to schedule a hearing date. Scheduling a hearing incurs filing fees to the employer. It may be that the employer has already paid the fees with the claim submission, in which case the clerk assigns a hearing date, and the process completes. It may be that additional fees are required, but the employer has already paid those fees as well. In this case, the clerk generates a receipt for the additional fees and proceeds with scheduling the hearing. Finally, if the employer has not paid the required fees, the clerk issues a payment notice and waits for the employer to pay before reassessing the claim’s compliance.
