QUESTION 2 – 8 Pоints Scоtt wаs а pаssenger in James' Tesla car when the frоnt brakes locked forcing the car off the road. The car rolled over several times causing serious injuries to both Scott and James. At the time of the accident, James was sending a text message to his parents. A section of the Wisconsin Statutes (Section 346.89(3)) provides that “No person may drive . . . any motor vehicle while composing or sending an electronic text message or an electronic mail message.” The car was equipped with Klio brand brakes which brakes were manufactured in a negligent manner and that manufacturing defect was a factor in the accident leading the brakes to lock and the car to veer off the road. It has also been determined that the Tesla car that James was driving had a design defect which made it more susceptible to rollovers. Finally, it was determined after the crash that the City of Milwaukee where the accident took place failed to properly maintain the shoulder of the road which made the truck roll over with more speed than it otherwise would have thereby adding to the severity of James’ and Scott's injuries. REQUIRED - 8 Points: James has sued Klio based on a claim of negligence and has succeeded in his claim (that is, James won). In separately lettered or numbered paragraphs discuss each of the elements of James successful negligence cause of action against Klio. Do not discuss the negligence claim against Tesla or the City of Milwaukee.
