Questiоns 11 аnd 12 аre bаsed оn a similar fact pattern.  Mary is a large landlоrd in the Riverside area. She owns five large apartment buildings with over 200 total apartments ranging from studio apartments to three-bedroom apartments. There is a constant turnover of tenants in her buildings due to the natural turnover of so many units.  It is Mary’s practice to always repaint apartments when the apartment turns over. For years she had employed Patricia to repaint the apartments as they became vacant. However, three months ago, Mary fired Patricia because Patricia was too slow at completing the painting, costing Mary lost rental income. Mary decided to hire David to do the repainting in the future. They entered into a valid written contract whereby David would repaint all vacant apartments with a payment schedule based upon the size of the vacant apartment to be repainted.  The first five apartments that David repainted were white and David repainted each apartment white. Mary was satisfied with each repainting job and promptly paid David.  The sixth apartment that David was to repaint was originally blue. David, however, painted this sixth apartment white, like the last five apartments that he had painted.  11. Mary was furious because of the different color of the painting job.
