In а recent аrticle, а prоminent administrative law prоfessоr writes the following:                 The extreme political polarity that has evolved in recent years will have major effects on the legal environment that is created by Loper Bright and the Courtʼs other recent administrative law opinions. The effects of extreme political polarity include the near complete inability of Congress to enact statutes that address the major policy issues that confront the nation.                In 1984, when the President identified an issue that required a government response of some type, he assembled his advisors to discuss the best way to persuade Congress to address the issue by enacting a statute. He then worked with the leadership of both parties in both Houses to draft and enact a statute that reflected the many compromises that were made during the process of drafting and enacting the statute. That process almost invariably produced a legislative response that was supported by both parties and enacted by an overwhelming majority. The response usually consisted of a statute that conferred power on an expert agency within broad statutory boundaries.              If a modern president asked his advisors to suggest a way in which Congress could address an issue, the question would elicit widespread laughter. Members of both parties in both Houses are reluctant even to consider the kind of compromises that are required to draft legislation that can be supported by a bipartisan majority.  Any such overture by a member would produce an effort to “primary” the member out of office.             In this legislative environment, the most that any president can expect to accomplish is enactment of a few statutes early in his Term by a narrow partisan vote. Even that is not plausible unless the Senate parliamentarian decides that every provision of the statute falls within the tax power of Congress, thereby avoiding the need to obtain a 60-vote majority in the Senate. It is impossible for Congress to enact, repeal, or amend a statute that confers regulatory power on an agency. With legislative action out of the question, the president has no choice but to act unilaterally . . .   Please write an essay responding to this except. In thinking about the issues raised in the article, you must consider the effects the described phenomena have on the legislative process and the likelihood good laws will result.  Choose the topic of your essay from one of the subjects below.  No matter which topic you choose you must address your arguments to the problems described in the article.  (You may argue that the problems are common across the political spectrum.)              OPTION ONE: One solution you can choose to address concerns proposed structural reforms of the legislative process such as the committee process reforms, the elimination of the filibuster, the single subject rule and the enforcement of the rules governing the legislative body.   Write a memorandum, first, describing the legal and policy issues involved in these kinds of devices and then advocating a particular position regarding the implementation or reform (including elimination) of these devices.  (Please be as specific as possible as to which mechanisms you do or do not support.)  Make sure both that you explain the theory underlying your position and that you refute competing arguments.               OPTION TWO:  You can choose to argue that the problems described in the article could be better addressed by reforming the structures and rules governing our electoral system, including the practice and legal treatment of political gerrymandering.  Write a memorandum describing the legal and policy issues involved in the use of these structures and then advocating a particular position regarding the implementation of these structures.  (Please be specific as possible as to the specific rules and mechanisms you do or do not support.)  Make sure both that you explain the theory underlying your position and that you refute competing arguments.   OPTION THREE:  You can choose to argue that the problems described in the article could be better addressed by implementing direct democracy mechanisms, including the initiative, referendum and recall.  Write a memorandum describing the legal and policy issues involved in the institution of direct democracy and then advocating a particular position regarding the implementation of this reform.  (Please be specific as possible as to the specific rules and mechanisms you do or do not support.)  Make sure both that you explain the theory underlying your position and that you refute competing arguments.                                                                       GOOD LUCK!
