Dаnny Defendаnt is а cоntractоr whо installs the large light poles for parking lots. One day, he stopped in a strip mall to eat lunch at one of the restaurants therein. After lunch, on the way back to his work truck, he saw a light pole like the ones he installs lying on the ground in the ally on the delivery side of the building. The light pole appeared old and was rusted in some places and was lying next to the dumpster. Danny, knowing that those poles cost over $1,000 if purchased new, decided to take it, so he loaded the pole up onto his trailer and brought it back to his shop. Over the next couple of days, he repaired the dents, cleared the rust and repainted the pole, and installed it at his next jobsite. Unfortunately for Danny, the owner of the building caught the whole incident on his security cameras and filed a police report, claiming the pole was stolen.
