All other claims are preserved by a wrongful death statute. The statutory beneficiaries under the wrongful death statute are the decedent’s heirs. Otherwise, Columbia follows the common law. Phone: 323-436-9785; address:  Rt 2, Box 682 Village Loop Road, Everytown, Columbia Danny, who is in the middle of a dispute over millions of dollars with his business partner, Kevin, read the ad and called the number. Danny asked Darren if he would kill Kevin. Darren agreed to kill Kevin for $50,000, $25,000 in advance and $25,000 after the job was done. Kevin, who knew he had enemies, lived in an exclusive gated community named Safe Place, Inc. (herein after “Safe”) with 24-hour security. After receiving $25,000 cash, Darren went to Safe dressed in work clothes and carrying a toolbox.  The guard on duty, per the usual practice, was wearing a uniform that said only “Safe Place Security.” Darren told the guard that Safe management had sent him to fix plumbing.  The guard opened the gate for Darren without requiring picture identification or verifying with Safe management that a plumber had been called. The guard did not actually work for Safe but for Best Security, LLC (hereinafter “Best”) who contracted to provide security with many complexes in the area. Best had a very good reputation and had given Safe excellent service. The guards reported to a Best supervisor who directed the time, place and manner of their job performance.  Darren went to Kevin’s street just as Kevin was pulling out of his driveway. Darren took a Mac 10 automatic pistol with a silencer from his toolbox and fired several rounds though the front window striking Kevin. Kevin was able to get out of the car but shortly collapsed. Darren shot Kevin in the head, killing him. In the seven years prior to Darren’s ad, five murders, two kidnappings and three assaults had been traced to similar ads in Warrior. In each case the respective police departments contacted Warrior to find more information about the perpetrators. Kevin’s only heirs were his two sons Paul and Ian. Kevin left a will giving half of his estate to his girlfriend Patty and the other half to his sons equally. Please set out all claims and defenses of any party including the types and allocation of any damage.
